Please read the following Terms, Conditions and acknowledgments carefully before using Musaned portal. By using Musaned portal, you confirm that you have accepted these terms, conditions and acknowledgments and that you will comply with all its contained provisions.

Definitions:

Customer Liabilities and Acknowledgments:

  1. The Customer acknowledges his awareness and observance of all conditions and regulations complying with the laws and regulations of the Ministry related to services of recruiting domestic labor and the like.
  2. The Customer shall be liable for taking all what is necessary in using information and inputs by The Portal and his knowledge and understanding of these terms, conditions and acknowledgments/declarations, in addition to complying with other applicable terms and conditions.
  3. The Customer shall be liable for all information provided by or uploaded in The Portal, including without limitation the digital inputs or uploaded documents from which the Customer must verify and update, and thus the customer acknowledges that all information provided by him is accurate and up-to-date and that he agrees to maintain such information through its accuracy and updating. In case of violating these Terms and Conditions or issuing fraudulent and/or false documents, the Customer shall be subject to the legal penalties and proceedings required in accordance with the provisions of item (suspension and termination) below and other applicable regulations.
  4. The Customer shall be liable for his own account in The Portal and acknowledges that he is the sole user of the account. And accordingly, all the activities of the account are legally binding for the customer in his capacity as the account holder.
  5. The Customer acknowledges that the Service Provider shall have the right to verify and evaluate the integrity of documents uploaded by Customer in The Portal and that the Service Provider shall have also the right to reject any incomplete or inaccurate applications or applications containing fraudulent or false information. The Service Provider shall also be entitled to delay the completion of the required process for further evaluation of the integrity of the documents or in case of having technical difficulties, in addition to the eligibility of the Service Provider to accept / reject / cancel any applications or contracts submitted or issued without prior notice.
  6. The Customer acknowledges that in case of having any errors upon using any of the services provided through The Portal, The Portal and the Ministry shall not be held responsible for any financial or legal losses arising. The Customer shall be responsible for submitting a report about the errors through opening an electronic support ticket through the e-mail center in Musaned or through http://muaned.com.sa/support . The Service Provider or his representative will take appropriate action and notify the customer with it.
  7. The Customer acknowledges that he has authorized the Service Provider or his representative to verify from any information provided with an aim to accept or reject the request of the Customer, customer service or any other procedure in which the data used by the customer is utilized by any of the governmental and civil authorities

Responsibility limitations:

  1. These Terms, Conditions and acknowledgments do not include any exception or limitation for the responsibility of the Service Provider for death or personal injury arising out of negligence, fraud or misrepresentation of the facts by the service provider, or any other responsibilities that cannot be excluded or restricted under the provisions of the applicable Saudi laws and regulations.
  2. To the extent permitted by law and regulation, the Service Provider excludes all terms, undertakings and declarations or other provisions that may apply to The Portal or any of its contents, either being explicit or implicit.
  3. The Service Provider shall not charge any responsibility or legal implications in facing any other Customer using Musaned regarding any loss or damage, either contractual or liability in tort, including negligence, breach of a legal duty or otherwise, even if it was expected and resulted under or concerning the following: Use or inability to use Musaned; and / or. Use or rely on any content displayed on Musaned.
  4. The Service Provider shall not be respI pledge to confirm the validity of the data entered the desire to raise the request.onsible for any loss or damage caused by a virus, illegal logging into Musaned or any other harmful materials that may technically affect the hardware and software of the computer or data or other materials returned to the Customer as a result of using Musaned or as a result of downloading any content from Musaned by the Customer or from any other portal linked to Musaned.
  5. The Service Provider shall not be responsible for the contents of other web portals linked to Musaned and these portals should not be interpreted as being certified by the Service Provider. Therefore, the Service Provider shall not be held responsible for any loss or damage that may arise from the Customer's use of such links or Musnaed.

Intellectual properties and trademarks:

“Musaned” is a trademark registered in the Kingdom of Saudi Arabia for Takamol for Business Services Holding Company; a government-owned limited liability company operating under the umbrella of the Ministry of Human Resources and Social Development. All intellectual properties or trademarks that are not owned by the Ministry or Musaned or Takamol and that appear on the portal are taken into account as being owned by its owners. The customer may not use any of these trademarks or any of its various forms for promotional purposes or purposes having a claim or giving intentional or unintentional impression of having a relationship with the owner of the concerned trademark. The Portal shall not include what explains – either explicit or implicit or otherwise – that the service provider shall grant any license or right to use any of the trademarks offered at the portal without a written permission from the trademark owner.

Prohibited Uses:

The Customer can use The Portal only for lawful purposes. The customer may not use The Portal for any of the following – for example but not limited to-:

  1. Any way having a violation for any of applicable laws and regulations at local or national or international level
  2. Any way that is illegal or fraudulent or having any purpose or having an illegal or fraudulent effect
  3. For the purpose of causing damage or trying to affect minors in any way
  4. Intentionally send or receive or upload or download or use or reuse any material that does not comply with the approved standards of the content as described below - for example but not limited to-:
    1. Transferring or assigning what is necessary to send any unrequired or unauthorized advertising or promotional materials or any other form similar to the present challenge (spam).
    2. Knowingly transfer any data and send or upload any materials containing viruses, Trojan horse or Computer worms, time bombs, snipers, spyware, or other malicious software or similar computer code designed to negatively affect any programs or computers.

Changing / modifying these conditions:

These terms, conditions and acknowledgments, in addition to the additional terms applicable to your use of portal are subject to continuous updates and changes as required. And any modification or update to any of these Terms and Conditions shall become effective immediately after being approved by the Service Provider; which requires reviewing these terms, conditions and principles of responsibility limits of the Service Provider and those who are responsible for The Portal in a regular manner for knowing any updates. Your continued use of portal means that you are fully informed of and accepted any modifications made to the conditions of its use, noting that these Terms and Conditions include the property rights, and the Service Provider is not required to announce for any updates or modifications made to these conditions.

Visa issuance costs:

  1. From the personnel recruitment departments: The Customer can issue the visa through the personnel recruitment departments of the Ministry around the Kingdom of Saudi Arabia and it requires only governmental fees
  2. From The Portal: The Customer acknowledges that the issuance of the visa through The Portal will cost him an amount of $ 150, only one hundred and fifty Saudi riyals for each visa for domestic worker, in addition to governmental fees, taking into consideration the following: A. The Customer may request for a refund of the fees of issuing the visa mentioned in item (2) above upon the rejection of the application within one Gregorian calendar year from the date of rejecting the application. This shall be done by filing a request for refunding the amount through The Portal. The process of refunding the amount shall take a period of no more than 30 days from the date of the request, noting that The Portal may deduct the costs of the process from the refunded amount. B. The Customer’s payment of the fees of obtaining the visa by Musnaed portal does not necessarily mean that he is entitled to the domestic worker visa, but he shall be subject to the absolute discretion of the Ministry of Human Resources and Social Development and the other related authorities.

Suspension and termination:

At the discretion of the Service Provider, it will determine whether or not there is a breach of the terms of using The Portal by the Customer. If it is found that there is a breach of these Terms and Conditions, the Service Provider may take the actions that the Service Provider deems as appropriate. The failure in complying with these Terms and Conditions and declarations or in the event of having fraud actions or forgery by the Customer may lead to taking all or any of the following procedures – for example, but not limited to -:

  1. Immediate withdrawal, temporarily or permanently, of the customer's right to use the portal.
  2. Immediate removal, temporarily or permanently, of any data or materials that the Customer has uploaded to The Portal.
  3. Addressing a warning to the Customer.
  4. Taking legal action against the Customer to seek compensation for all costs (including, but not limited to, the administrative and legal costs) resulting from breaching these conditions.
  5. Taking further legal action against the Customer.

Applicable laws and regulations:

These Terms and Conditions and declarations and its subject matter are subject to the provisions of the laws and regulations of the Kingdom of Saudi Arabia. The courts of Saudi Arabia shall have the exclusive jurisdiction in this regard. In case of considering some of these Terms and Conditions are invalid or unenforceable under the laws and regulations applicable in the Kingdom of Saudi Arabia, it will not affect the validity and mandatory of the rest of provisions and items on the users of The Portal

Communications and comments:

  1. The Customer can communicate with the customer service in any subject matter relating to the system or Portal or services including, but not limited to: general inquiries, suggestions, claims or disputes by communicating with the Customer Service Center through http://musaned.com.sa/support (or by a written notice submitted to the location of the Customer Service Center. The notice shall not be considered as being received by the customer service unless the customer received a notice either electronic or written confirming receiving the notice.
  2. All notices and notifications of Musaned system will be sent to the address registered in the customer's account in The Portal. The notification by such way shall be considered as an official one either electronic or postal or manual and the notification shall be effective from the date of its sending.
  3. The Customer shall be committed to provide the Service Provider with any change or modification in his address or information.
